Terms of Service

Effective date: October 26, 2026

These Terms of Service (the “Terms”) form a binding agreement between you and PiQQs Digital Entertainment LLC, a Florida limited liability company (“PiQQs,” “we,” “us” or “our”). They govern your access to and use of the PiQQs Universe applications for connected TV devices, the website located at piqqsuniverse.com, and all content, features and services made available through them (collectively, the “Service”).

By accessing or using the Service, or by creating an account, you acknowledge that you have read, understood and agree to be bound by these Terms and by our Privacy Policy, which is incorporated into these Terms by reference. If you do not agree, you may not access or use the Service.

1. Eligibility

You must be at least 18 years of age, or the age of legal majority in your jurisdiction if higher, to create an account or make a purchase. Minors may use the Service only through an account held by a parent or legal guardian, who is responsible for the minor’s use of the Service, including all content viewed and all purchases made. The Service provides tools such as kids profiles, limited profiles and a Parent PIN to help account holders manage access.

2. Accounts and Security

  1. You agree to provide accurate, current and complete information when you register and to keep that information up to date, including your email address.
  2. You are responsible for maintaining the confidentiality of your password and for all activity that occurs under your account, including activity on any device you have signed in to the Service.
  3. Signing in a TV device with an activation code links that device to your account. If a device is lost or you suspect unauthorized use of your account, you must promptly change your password and notify us.
  4. Your account is for personal use by you and members of your household. You may not sell, rent, transfer or otherwise share access to your account with anyone outside your household.

3. Service Tiers and Offerings

  1. Free (ad-supported). Selected content is available at no charge and is supported by advertising.
  2. Paid Plan. A recurring monthly subscription that provides access to all content, including content designated as Paid-tier, presented without advertising.
  3. Show Subscriptions. Certain shows are offered as separate monthly subscriptions. For each such show, the creator commits to releasing a minimum number of new episodes within each 30-day billing period. If fewer episodes are released in a billing period, you will receive a pro-rated refund for the shortfall in that period. Episodes of a show to which you subscribe are presented without advertising.
  4. Rentals. Certain films and documentaries are available to rent. A rental may be viewed an unlimited number of times, without advertising, during the rental period disclosed to you before purchase. Upon expiration of the rental period, the content is no longer available unless rented again.

The content available through the Service changes from time to time. We may add or remove content at any time, and some content may not be available on all devices or in all territories. Playback quality depends on your device, internet connection and other factors outside our control.

3a. Saved Data, Viewing History and Personalized Features

To operate the Service, we record and save information about how your account uses it, including the titles you watch and for how long, where you stopped in each title, each profile’s watch history, My List and your profiles and settings, as described in our Privacy Policy. By using the Service, you agree that we may collect, save and use this information to provide, personalize, measure and improve the Service.

4. Payments, Automatic Renewal and Refunds

  1. Payment processing. Purchases are processed by the app store or payment platform associated with your device (for example, the Amazon Appstore on Fire TV, Google Play on Google TV, or Roku Pay on Roku devices) or by our website’s payment provider. Those providers handle your payment information, and their terms and policies govern the payment transaction.
  2. Automatic renewal. Subscriptions renew automatically at the end of each monthly billing period at the then-current price until you cancel. To avoid being charged for the next period, you must cancel through the same platform you used to subscribe at least 24 hours before your renewal date. Following cancellation, you will retain access until the end of the billing period for which you have already paid.
  3. Pricing. All prices are displayed before purchase and include any applicable taxes collected by the payment platform. If we change the price of a subscription, the new price will take effect at your next renewal following advance notice from us or the payment platform.
  4. Refunds. Except for the Show Subscription shortfall refunds described in Section 3(c), or as otherwise required by applicable law, all payments are final and non-refundable. Refund requests for purchases made through an app store are subject to that store’s refund policies and procedures. For purchases made on our website, please contact support@piqqsuniverse.com.

5. Advertising

The free, ad-supported portion of the Service is funded by advertisements that may appear before or during content. Some advertisements are delivered by third-party advertising partners. Content designated as made for kids displays only non-personalized advertising. Additional information about advertising is available in our Privacy Policy.

6. Creator Content

Much of the content on the Service is created by independent creators (“Creator Content”). Creators are solely responsible for their Creator Content and must agree to the PiQQs Creator Agreement before uploading. Although we review certain content before publication, we do not review all content and do not endorse any opinion, statement or representation expressed in Creator Content. Content ratings and labels, such as “Reality TV,” “Documentary” and “Created with AI,” are provided for informational purposes to help you make viewing choices, and may not be suitable for every viewer. Sexually explicit content is not permitted on the Service. Uploads are screened, including by automated tools, and creators who misrepresent their content or break our content rules may have videos removed, earnings withheld, and their accounts suspended or terminated. To report content that you believe violates the law or these Terms, use the Report option on the video’s details page in the app, or contact support@piqqsuniverse.com.

Right to remove content. PiQQs reserves the right, at its sole discretion and without prior notice, explanation or liability, to remove, disable access to, restrict or decline to publish any content on the Service, including Creator Content, at any time and for any reason or no reason, including where we believe the content violates these Terms, the Creator Agreement or applicable law, or is otherwise objectionable or inappropriate for the Service. We are not required to tell you or the creator why content was removed, except where applicable law requires us to.

7. Copyright

We respect the intellectual property rights of others and respond to notices of alleged infringement in accordance with the Digital Millennium Copyright Act (“DMCA”). For instructions on submitting a notice or counter-notice, please see our Copyright Policy. In appropriate circumstances, we will terminate the accounts of users who are repeat infringers.

8. License and Acceptable Use

Subject to your compliance with these Terms, we grant you a limited, personal, non-exclusive, non-transferable, non-sublicensable and revocable license to access and view the content made available to you through the Service, on your own devices, for personal and non-commercial purposes. You agree that you will not, and will not permit any other person to:

  1. copy, download (except as expressly enabled by the Service), record, reproduce, rebroadcast, distribute, sell or publicly perform or display any content;
  2. circumvent, disable or interfere with advertising, payment mechanisms, content ratings, Parent PINs or any security or access-control feature;
  3. artificially inflate or manipulate views, viewing time, rankings, ad impressions or other measurements of the Service, including by using automated means or by leaving content playing without anyone watching in order to affect them;
  4. copy, modify, adapt, decompile, reverse engineer, resell or create derivative works of the applications or website, or access the Service using bots, scrapers or other automated means;
  5. use the Service for any unlawful purpose, to harass or harm any person, or in any manner that disrupts the Service or another user’s use of it; or
  6. impersonate any person or entity, or provide false information to us or to any payment platform.

9. Intellectual Property

The Service, including the PiQQs™ and PiQQs Universe names and logo, PiQQs Originals, and the applications and website, together with all related software, designs and materials, is owned by PiQQs or its licensors and is protected by copyright, trademark and other intellectual property laws. Content made available through the Service is owned by its respective creators or licensors. Except for the limited license granted in Section 8, these Terms do not grant you any right, title or interest in the Service or any content. PiQQs™ is a trademark used by PiQQs Digital Entertainment LLC under license from its owner (application pending with the U.S. Patent and Trademark Office); you may not use it, or anything confusingly similar, without written permission.

10. Suspension and Termination

You may stop using the Service at any time and may request deletion of your account by contacting us. PiQQs reserves the right, at its sole discretion, to suspend, terminate or delete any account, including viewer accounts and creator accounts, at any time and for any reason or no reason, with or without notice and without explanation, except where applicable law requires notice or a statement of reasons. Without limiting this right, we may suspend or terminate your account if we believe that you have violated these Terms, engaged in fraud or payment abuse, or created a risk to other users or to the Service. If we terminate your account for reasons unrelated to your conduct, we will refund any prepaid subscription fees for the unused portion of your current billing period. Sections 9 and 11 through 17 survive any termination of these Terms.

11. Disclaimer of Warranties

The Service is provided on an “as is” and “as available” basis. To the fullest extent permitted by applicable law, PiQQs expressly disclaims all warranties of any kind, whether express, implied or statutory, including any implied warranties of merchantability, fitness for a particular purpose, title and non-infringement. PiQQs does not warrant that the Service will be uninterrupted, timely, secure or error-free, or that any particular content will remain available.

12. Limitation of Liability

To the fullest extent permitted by applicable law, in no event will PiQQs or its members, managers, officers, employees, agents, licensors or partners be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of profits, revenue, data or goodwill, arising out of or relating to your access to or use of the Service, whether based on warranty, contract, tort (including negligence) or any other legal theory, even if advised of the possibility of such damages. The aggregate liability of PiQQs for all claims arising out of or relating to the Service will not exceed the greater of (a) the total amount you paid to PiQQs in the twelve (12) months preceding the event giving rise to the claim, or (b) fifty U.S. dollars (US$50).

Some jurisdictions do not allow the exclusion or limitation of certain warranties or damages, so some of the above exclusions and limitations may not apply to you.

13. Indemnification

You agree to indemnify, defend and hold harmless PiQQs and its members, managers, officers, employees and agents from and against any claims, liabilities, damages, losses and expenses, including reasonable attorneys’ fees, arising out of or relating to your violation of these Terms or of any applicable law in connection with your use of the Service.

14. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Florida and applicable federal law of the United States, without regard to conflict-of-law principles. Before initiating any formal proceeding, you agree to first contact us at support@piqqsuniverse.com and attempt in good faith to resolve the dispute informally. Any dispute that cannot be resolved informally shall be brought exclusively in the state or federal courts located in the State of Florida, and you and PiQQs consent to the personal jurisdiction of those courts.

15. Third-Party Platforms

If you access the Service through a third-party device or app store, such as Amazon, Google or Roku, your use of that platform is also subject to its own terms and policies. These Terms are between you and PiQQs only, and the platform provider is not responsible for the Service or its content.

16. Changes to These Terms

We may revise these Terms from time to time to reflect changes to the Service or applicable law. The revised Terms will be posted on this page with an updated effective date, and for material changes we will provide notice through the Service, on our website or by email. Your continued use of the Service after the revised Terms take effect constitutes your acceptance of them.

17. General Provisions

These Terms, together with the Privacy Policy and any additional terms that apply to specific features, constitute the entire agreement between you and PiQQs regarding the Service. If any provision of these Terms is held to be invalid or unenforceable, that provision will be enforced to the maximum extent permissible and the remaining provisions will remain in full force and effect. Our failure to enforce any right or provision will not constitute a waiver of that right or provision. You may not assign or transfer these Terms without our prior written consent; we may assign them without restriction. We will not be liable for any delay or failure to perform resulting from causes beyond our reasonable control.
